Welcome to Fairwayr ("we", "us", "our"). These Terms of Service govern your use of our platform: the local golf community app for finding rounds, buying and selling gear, and connecting with golfers near you. By creating an account or using Fairwayr, you agree to these terms.

1. Acceptance of Terms

By accessing or using Fairwayr, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use our services. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 16 years old or the age of legal consent in your jurisdiction to use Fairwayr. By using our platform, you represent that you meet this requirement and have the legal capacity to enter into a binding agreement. If you are using Fairwayr on behalf of a business or organisation, you represent that you have authority to bind that entity.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain your password securely and notify us of any unauthorised access.
• Accept responsibility for all activity under your account.

4. Use of Our Services

Fairwayr provides three main features: rounds (finding and joining golf games), marketplace (buying and selling golf gear), and networking (connecting with golfers). You agree to use our services only for lawful purposes and in accordance with these terms.

You must not:

• Violate any applicable law or regulation.
• Infringe the intellectual property or other rights of others.
• Harass, abuse, defame, or otherwise harm other users.
• Post false, misleading, or fraudulent content (including listings or profiles).
• Use the platform for spam, unsolicited marketing, or commercial purposes beyond permitted use.
• Attempt to circumvent security, access controls, or payment systems.
• Scrape, harvest, or collect data from the platform without permission.

5. Rounds

When you host or join a round through Fairwayr, you are responsible for your own conduct and any arrangements made with other users. Fairwayr facilitates introductions but does not guarantee the availability, quality, or safety of any round. Any financial arrangements (e.g. green fees, cost sharing) are between you and other participants. Fairwayr is not a party to those transactions.

6. Marketplace

The marketplace allows users to buy and sell golf gear. Fairwayr provides the platform but does not take ownership of items or guarantee transactions. You are responsible for:

• Accurate descriptions and pricing of items you list.
• Completing transactions in good faith and as described.
• Meeting in person or arranging collection as agreed. Fairwayr encourages local, no-shipping transactions.

We are not responsible for disputes between buyers and sellers. We may remove listings or suspend accounts that violate our policies or applicable law.

7. Content and Conduct

You retain ownership of content you post (e.g. profile photos, listings, messages). By posting, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content for the purpose of operating and promoting Fairwayr.

We may remove content that violates these terms or our community standards. We reserve the right to suspend or terminate accounts for repeated or serious violations.

8. Disclaimers

Fairwayr is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or secure. We are not responsible for the conduct of users, the quality of rounds, or the accuracy of marketplace listings. You use Fairwayr at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, Fairwayr and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of our services. Our total liability shall not exceed the amount you have paid to us in the twelve months preceding the claim (or £100 if greater). Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Indemnification

You agree to indemnify and hold harmless Fairwayr, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these terms, or your violation of any third-party rights.

11. Termination

You may close your account at any time. We may suspend or terminate your account if you breach these terms or for any other reason at our discretion. Upon termination, your right to use Fairwayr ceases immediately. Provisions that by their nature should survive (e.g. disclaimers, limitation of liability, indemnification) will survive termination.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may have additional rights under your local consumer protection laws.

13. Changes

We may modify these terms from time to time. We will notify you of material changes via email or a notice on our platform. The "Last updated" date at the top reflects the most recent version. Continued use after changes constitutes acceptance.
